Terms and conditions
This document defines the conditions applicable to sales between, persons wishing to make a purchase via the website http://www.OhMyLuckyDay.com, hereinafter referred to as "client" , and SARL Keno-Moon – OhMyLuckyDay.com whose headquarters is located at 18 rue de la Monnaie, 69002 Lyon, France, RCS number 450 728 134 at Lyon, hereinafter referred to as "OhMyLuCkyDay.com" .
The fact that the client confirms his order on the site OhMyLuckyDay.com means a full and complete acceptance of these terms and conditions in their entirety.
This contract will be governed by the French law.
1. Products
OhMyLuckyDay.com sells quality products, manufactured by known and respected factories, which apply strict quality control.
All items are new and genuine. Some products were tried by clients at shops.
The articles on OhMyLuckyDay.com are fully or partially handmade from natural leather.
slight marks or colour variations should not be considered as a fault but they are inherent characteristics of the product.
2. Price
All product prices are quoted in Euros, all taxes included, except the costs of shipping (see paragraph 6: Delivery).
OhMyLuckyDay.com reserves the right to change its prices at any time without notice. The products will be charged on the basis of the rates in force, at the time of order. The products remain the property of OhMyLuckyDay.com until full payment.
3. Ordering
The client may place an order over the Internet via the website http://www.OhMyLuckyDay.com.
OhMyLuckyDay.com reserves the right to cancel or refuse any order from a client with whom there is a dispute regarding payment of a previous order, or if it presents, in its view, any form of risk.
Any order implies acceptance of price and description of products available for sale.
OhMyLuckyDay.com agrees to deliver orders received on its website only within the limits of available stocks of products.
The information on the availability of products supplied to clients at the time of order. In the event of unavailability of a product after placing the order, OhMyLuckyDay.com will inform the client by e-mail or by mail as soon as possible. The order will be automatically cancelled and the payment will be refunded.
The information stated by the client while ordering, is by his responsibility. In case of error in the delivery information given by the client, OhMyluckyDay.com could not be held responsible for failure in delivery. Consequently, the buyer will bear the cost of shipment.
4. Payment
One payment should correspond to the totality of the order and shipping.
The payment should be made in one of the following ways:
A. credit card: Visa, MasterCard, Carte Bleue.
B. check.
C. Paypal
In case of payment by check, it must be issued by a bank domiciled in France and payable to OhMyLuckyDay.com. It should be sent to OhmyLuckyDay.com, 18 rue de la Monnaie, Lyon 69002, France.
The products ordered are reserved 6 days from the date of order. After this delay and non-receipt of the check, OhMyLuckyDay.com reserves the right to cancel the order. The check will be returned to the client.
The depositing is made on receipt of the check. The delivery will be made after the validation of depositing.
5. Transaction Security
OhMyLuckyDay.com implements all means to ensure the confidentiality and security of data transmitted over the web and on the website http://www.OhMyLuckyDay.com.
The payment by credit card is managed by BNP Paribas Mercatel: secured online payment echnology.
Payment by papal is managed by PayPal Inc.
6. Delivery
OhMyLuckyDay.com treats all commands in the following areas:
Zone 1: France, Monaco, Andorra.
Zone 2: European Union, Switzerland, Norway.
Zone 3: DOM: Guadeloupe, Martinique, French Guiana, Reunion, Mayotte, Saint Pierre and Miquelon, Saint-Martin, St. Barthelemy.
OhMyLuckyDay.com has chosen the French postal services (“La Poste”) as its supplier of shipping services.
We guarantee to ship orders within 48 hours (two business days) after the validation of payment.
In case of payment by check, the delivery will be made after the validation of the depositing.
Zone 1:
Orders are sent by "colissimo" (postal delivery time: 48 hours).
Costs of shipment: 7.65€.
Zone 2:
Orders are sent by "colissimo international".
Costs of shipment: 17.45€.
Zone 3:
orders are sent by "colissimo overseas".
Costs of shipment: 17.15€.
6.1 Regrouping purchases
For each additional item added and sent in the same package, OhMyLuckyDay.com takes the additional shipping costs at its charge. The client pays only the minimum costs of shipment as mentioned above.
collecting the purchase at the boutique "Bonnie & Clyde" Lyon is possible as well, and free of charge.
Address: 18 rue de la currency; Lyon 69002.
Hours: Tuesday-Saturday 10.30-13.30, 14.30-19.00.
To collect the package at the boutique, identity cards, and the printed order form, are necessary.
The package will be available at the boutique, 48 hours after validation of payment.
6.2 Taxes and regulations at destinations outside France.
Clients in foreign countries are advised to consult their local authorities regarding taxes and regulations concerning their purchase. Any taxes and costs charged by the authorities at a forein country will be on the charge of the client.
7. Returns
OhMyLuckyDay.com allows its clients to return items ordered within 14 days from the date of receipt of the order.
The product returned must be new, unused and in their original box.
The return can be done directly in boutique "Bonnie & Clyde" (address and hours: above)
or by post, to: OhMyLuckyDay.com 18 rue de la Monnaie, 69002 Lyon, France.
If the client has selected the post for his return package, he/she should keep proof of shipment. This proof, given by the post, includes the number of the package, its weight and the date of shipment at the post office. In case of disagreement, OhMyLuckyDay.com requires the client proof of postal shipment. In case of loss of the package, no refund will be made without such proof.
All returned products (shoes, original packaging, accessories, notice ...) should be returned in the state in which the client has received.
On receipt of the package by OhMyLuckyDay.com, we inspect the perfect condition of the returned merchandise. No returns will be accepted if the products were returned visibly used, or damaged because of client use.
If the return is denied by OhMyLuckyDay.com, the products will then be returned to the client on the expense of OhMyLuckyDay.com.
The client may not require any further compensation or rights for a refund.
8. refunds
Subject to compliance with the conditions of return listed in paragraph 7, OhMyLuckyDay.com will refund products returned within 15 days from the receiving of the returned goods.
refund will be made in the same way of payment by the client (credit card, check or Paypal). shipment costs are not refunded.
9. Disclaimer
OhMyLuckyDay.com has, for all stages of access to the site, the ordering process, delivery, client service or post services, an obligation of means. The responsibility of OhMyLuckyDay.com can not be held liable for all damages or disadvantages inherent in the use of the Internet network, including connection interruptions, an external intrusion, or the presence of viruses, which described as force major, in accordance with the law.
10. disagreements and allocation of Competence
In case of disagreement, the client will address to OhMyLuckyDay.com in order to find an amicable solution.
Otherwise, the Civil Tribunal of the headquarters of OhMyLuckyDay.com has exclusive jurisdiction, regardless of the place of delivery and mode of payment accepted.
11. Intellectual Property
All texts, pictures and images reproduced on OhMyLuckyDay.com are reserved under copyright and as intellectual property worldwide. As such, and in accordance with the provisions of the code of intellectual property, are permitted only for private use purposes. Total or partial reproduction of OhMyLuckyDay.com site is strictly prohibited unless prior agreement. |
